This is the last Will and Testament of me Robert CROSSWELL of Durley
in the County of Southampton Builder. Whereby after payment of all my
just debts funeral and testamentary expenses I give and bequeath unto
my three sons Robert, Samuel and Alfred CROSSWELL all my stock in trade
and the goodwill of my business to be equally divided between them as
tenants in common. I give and bequeath unto my Wife Miriam CROSSWELL
all my household goods and furniture book debts monies and securities
for money and all other my personal estate and effects except as hereinbefore
disposed of for her own absolute us. And I give and devise unto her
my said Wife Miriam CROSSWELL her heirs and assigns all my Copyhold
or Customary messuages gardens land and premises and all other my real
estate whatsoever or wheresoever over which I have now or may at the
time of my decease have a disposing power. To hold the same to her heirs
and assigns according to the several natures or tenures thereof respectively
for her and their own absolute use. Yet nevertheless but without intending
to defeat limit or control the absolute power and right of my said Wife
to devise and bequeath sell or otherwise dispose of my said real and
personal estate so devised and bequeathed to her as aforesaid and every
part thereof at any time and in any manner she shall think proper I
hereby declare that if she my said Wife shall happen to die without
having sold or disposed of my said personal estate or any part thereof
by Will or >>>

>>> otherwise or without having sold mortgaged charged or disposed
of my said Copyhold hereditaments or other real estate either by deed
surrender or otherwise in her lifetime or by her last Will and testament
then and in such case I give devise and bequeath the same and every
part thereof or so much and such part or parts thereof respectively
as she my said Wife may not have sold mortgaged charged or disposed
of as aforesaid unto my Trustees hereinafter named. To hold to them
their heirs executors administrators and assigns respectively according
to the nature and quality of the same estates respectively. Upon trust
to sell and convert into money all such estates and effects or such
part thereof as shall not consist of money or securities for money and
out of the net proceeds to arise from such sale and conversion to set
aside the sum of One Hundred pounds and pay and apply the same in manner
hereinafter directed and to pay and divide the residue or surplus thereof
unto and equally between my three sons the said Robert Samuel and Alfred
CROSSWELL and my daughter Eliza Ann the Wife of Charles James BUNGEY
share and share alike as tenants in common. And if any or either of
them shall die in the lifetime of my said Wife without leaving any child
children or other issue them respectively surviving or leaving such
and such child children or other issue shall all have died under the
age of twenty one years then I will and direct that the share or shares
of my said Sons and daughter so dying whether original or accruing shall
go and belong to the survivors or survivor of them and the issue living
at the decease of my said Wife of such of them as shall have died in
her lifetime leaving issue as aforesaid in equal shares as aforesaid.
And
Proved at Winchester the twenty ninth day of November 1866 by the Oath
of Miriam CROSSWELL Widow the Relict the sole Executrix to whom administration
was granted. The Testator Robert CROSSWELL was late of Durley in the
County of Southampton Builder and died on the eighth day of September
1866 at Durley aforesaid.
