Will of Thomas BENHAM

Transcript of the Will of Thomas BENHAM: written 6th February 1748, proved 9 May 1758

In the name of God Amen I Thomas BENHAM of Frogmill in the parish of Durley in the County of Southampton Miller being Aged and Infirm of Body But of Sound and Perfect Mind Memory and Understanding (God be Praised) Do make publish and declare this my last Will and Testament in manner and form following (That is hereby). IMPRIMIS I give and bequeath unto my Son Thomas BENHAM the sum of Five Shillings of good and lawful Money of Great Britain. And to my Son John BENHAM the like sum of Five Shillings of like good and lawful Money. And to my daughter Ann (Now Wife of Richard PENNY [or PARRY]) the like sum of Five Shillings of like good and lawful Money. To be paid unto my said Sons and Daughter respectively at the End and Expiration of Six Months next Ensuing after my Death. And the Reason that I give them no more is because I have already provided for them respectively according to my Circumstances and Abilities. ITEM I give and bequeath unto my Son Arthur BENHAM the Sum of Five Shillings of Good and Lawful Money of Great Britain. To be paid unto him by my Executors at the End of Expiration of Two Years next Ensuing after my Decease. ITEM WHEREAS I am … … … or otherwise possessed of or entitled to Six Several Copyholds Situated, Lying and being within and part of the Manor of Bishop’s Waltham in the County of Southampton (five of which Said Copyholds are Surrendered for the Use of my Will) and the other thereof, to wit, Half an Acre of Bondland (whether more or less) lying between Lands called Humphrey's on the East part and a Meadow called King's Moad and the River of the Lord on the West in the Tything of Curdridge. On the Death or Intermarriage of my Wife Ann BENHAM (To whom the Same is Settled and Surrendered for and during the term of her Widowhood) will go and descend to my Youngest Son Reuben BENHAM and his Heirs according to the Custom of the Mannor aforesaid. An whereas I am ... ... or otherwise instilled for Costs in freehold Lands Tenaments and Hereditaments. Now I hereby give and devise unto my Said Wife Ann BENHAM the Said Freehold Lands Tenements and Hereditaments with the Appurtances. And also two of the Said Copyholds (by me Surrender'd as aforesaid)
